Terms of Service for Eliahna Photography

Business Name: Eliahna Photography (“we,” “us,” or “our”)

By booking a session, viewing this website, or purchasing services from Eliahna Photography, you (“Client”) agree to the following terms and conditions:

Services

Eliahna Photography provides professional photography services, including but not limited to portrait, event, and professional photography.

Specific services, session details, and deliverables are listed, but not limited to, in the "Services" section with package details.

Booking & Payment

A non-refundable retainer of 25% is required to secure your session date.

The remaining balance is due upon delivery of proofs.

Session dates are not confirmed until the retainer and signed agreement are received.

If the Client fails to pay the remaining balance as agreed, Eliahna Photography reserves the right to withhold delivery of images until payment is completed.

Cancellations & Rescheduling

Cancellations made more than 24hrs before the session may be rescheduled once, subject to availability.

The retainer fee is non-refundable but may be applied to a future session if rescheduled within 2 weeks.

Cancellations within 24hrs of the session may result in loss of all fees paid.

In the event of illness, weather conditions, force majeure, or circumstances beyond our control, Eliahna Photography will work with the Client to reschedule at a mutually convenient time.

Image Delivery

Edited digital images will be delivered via online gallery (Pixieset) within 1-3 weeks after the session unless otherwise stated.

Eliahna Photography is not responsible for delays caused by technical issues or third-party platforms.

All photographs remain the copyright property of Eliahna Photography.

Clients are granted a personal use license, which allows sharing, printing, and displaying the images for personal or professional use with proper crediting. Images may not be sold, altered, or used for commercial purposes without written consent from Eliahna Photography.

Photographer’s Portfolio & Promotion

Eliahna Photography may use selected images from sessions for promotional purposes, including portfolio display, website, social media, or marketing materials, with reasonable discretion.

Client Responsibilities

Clients are responsible for arriving on time and prepared for the session.

Late arrivals may reduce shooting time or result in cancellation without refund.

Clients agree to obtain necessary permissions or location releases if required.

Reasonably polite and respectful conduct is expected, and Eliahna Photography reserves the right to deny those disobeying.

Liability

Eliahna Photography will take all reasonable care to deliver high-quality images. However, in the unlikely event of equipment failure, data loss, or unforeseen circumstances beyond control, the photographer’s liability is limited to a full refund of any payments received. Eliahna Photography is not liable for incidental or consequential damages arising from the services provided.

Digital Files & Storage

Final images are available for download through the client’s Pixieset gallery from delivery. Expiration for download may vary.

After this period, files may be archived or deleted. Clients are responsible for saving backup copies.

Privacy

Eliahna Photography respects your privacy.

We collect and use personal data (such as name, email, and phone number) only to manage sessions and communication.

Governing Law

These Terms are governed by the laws of the state of Virginia.

Any disputes will be resolved in accordance with the laws of that jurisdiction.

We may update this Terms of Service occasionally to reflect changes in our practices or legal requirements.
